The nature of collaborative law is to work through issues in a transparent and non-aggressive way, allowing lawyers and clients to work together in resolving disputes. Collaborative law is facilitated by a neutral facilitator. Different to mediation, you may choose to invite other professionals into the process which such as a child specialist, who will work with parents and/or children, or a financial planner who may help with the property settlement.

This unique approach would note suit matters involving uncooperative parties nor cases with demonstrations of bitterness and incivility. Further, collaborative practice is unsuitable in situations where an intervention order is in place or aggressive behaviour is being exhibited.

In order for the collaborative process to occur, both clients need to engage solicitors who have been trained in collaborative law. Collaborative Law begins when both parties sign a participation agreement acknowledging that the process of collaborative law is a voluntary process, each party is prepared to engage in and be bound by the process however also acknowledges that the process essentially disqualifies each other’s respective lawyer’s right to represent either one in any future litigation.
